Good
afternoon
,
Our
bill
drafters
had
a
few
more
questions
regarding
the
sibling
rights
bill
draft
.
Let
me
know
how
to
best
address
these
!
1.
Section
(
5)
(
a
)
states
that
a
sibling
visitation
schedule
must
be
developed
that
“assures
that
the
siblings
enjoy
their
fundamental
right
to
enjoy
time
with
any
other
siblings
shown
to
be
involved
.
This
appears
to
apply
to
all
minor
siblings
,
rather
than
the
sibling
who
filed
for
companionship
and
visitation
rights
.
What
if
the
other
sibling
(
s
)
do
not
want
to
be
involved
?
2.
Section
(
7)
of
the
provided
language
reads
as
follows
:
“Modification
proceedings
relating
to
visitation
between
siblings
,
or
removal
of
children
from
the
jurisdiction
of
the
court
shall
be
commenced
by
filing
a
complaint
to
modify
6
0
days
prior
to
moving
.
Proceedings
to
modify
a
sibling
visitation
plan
shall
be
commenced
by
filing
a
complaint
to
modify
.
Such
actions
shall
be
referred
to
mediation
or
specialized
alternative
dispute
resolution
.
For
good
cause
shown
and
:
(
a
)
When
both
parties
agree
and
such
visitation
agreement
is
bona
fide
,
or
(
b
)
When
mediation
or
specialized
alternative
dispute
resolution
is
not
possible
without
undue
delay
or
hardship
to
either
party
,
the
mediation
or
specialized
alternative
dispute
resolution
requirement
may
be
waived
by
the
court
.
In
such
a
case
where
waiver
of
the
mediation
or
specialized
alternative
dispute
resolution
is
sought
,
the
court
shall
hold
an
evidentiary
hearing
and
the
burden
of
proof
for
the
party
or
parties
seeking
waiver
is
by
clear
and
convincing
evidence
.
Service
of
process
and
other
procedure
shall
comply
with
the
requirements
for
a
dissolution
action
.
a.
When
it
says
“the
removal
of
children
from
the
jurisdiction
of
the
court
,
is
this
referring
to
a
situation
where
a
case
is
certified
to
a
juvenile
court
under
R
.C.

6,
when
parent
relocation
results
in
a
different
court
location
,
or
both
?
b.
The
provision
requires
the
modification
motion
to
be
filed
6
0
days
prior
to
moving
,
which
appears
to
refer
to
the
certification
/
change
of
venue
.
How
does
this
apply
in
relation
to
a
modification
request
unrelated
to
a
certification
/
change
of
venue
?
I
.
e
.,
is
there
a
filing
deadline
in
other
circumstances
?
Thanks
